Have you sustained injuries to your lower back, head, neck, elbows or knees following a hard fall at work from a roof or a ladder?

In my Georgia workers’ compensation practice, I regularly represent clients who have sustained injuries arising from falls, and there are few important points to keep in mind.

First, for workers’ compensation purposes it does not matter if you were at fault when you fell. Perhaps you did not secure your ladder, or perhaps you were a careless about walking on an unsupported scaffold or ladder. Assuming that there was no “horseplay” going on, you are covered by workers’ compensation even if your injuries were the result of your own carelessness.

Second, you need think carefully about what you tell your doctor in your first few medical appointments. You may have significant pain at one place on your body but you must not forget to tell the doctor about other, less apparent, body part injuries. Insurance companies carefully examine the medical records generate by the emergency room physician and by the first doctors who treat you.

If, for example, you only talk to your doctor about a very painful elbow injury, but do not discuss lower back pain, headaches or ankle pain, you may find that down the road the insurance company will not pay for treatment of those other body parts.
